Section 5. Time of Day Restrictions
The Town voted to prohibit from Lake Buel the operation of either boats or other motorized equipment with motors exceeding 5 h.p., or motorized augers, after 12 midnight and before 8 a.m. without the special authorization of the Select Board; and to set a fine not to exceed $100 for each violation of this prohibition. The Lake in question is a “Great Pond,” a State Lake, and the Lake is partially contained in two towns, Monterey and New Marlborough. A hand vote was called and did approve the Article.
Note: On April 28, 1989 the Attorney General approved Section 5, subject to the following conditions, imposed by the Director of the Division of Law Enforcement as of May 2, 1989: “…[this bylaw] as it pertains to hp restrictions cannot be approved. This division has no authority to address the use of ice augers.”
