Article XVII. Pond and Lake Bubblers

In order to protect the public safety, no person or persons shall place in the waters or on the shores of Lake Garfield or the portions of Lake Buel within the boundary of the Town of Monterey any type of mechanical or electrically powered device that would prohibit the natural freezing of the waters.  The use of devices designed to artificially create a flow of water that restricts the natural freezing of the lakes, including so-called bubblers, is unlawful.
This bylaw may be enforced under the provisions of Chapter 21D of the Massachusetts General Laws, or under any other state regulation that may apply.
Any person or persons who operate said devices shall be fined $100 per day.
