Board of Appeals

Town Attorney J. Pollard
Mr. Pollard explained to the board that the US Post Office is not subject to Monterey’s zoning by-law. He provided the board with the legal citation. He explained that the board is allowed to discuss the town’s concerns regarding traffic and set backs. He instructed the board to open the hearing and then ask the Post Office to withdraw. If they refuse to withdraw the board must deny the petition for a variance on the grounds that the board lacks jurisdiction in the matter.
