KW stated that lack to a quorum the commission should continue for 165 Stevens Lake Way to the next meeting.  Mr. Hartman of Stevens Lake stated that he would be away.  The commission agreed that Mr. Hartman can voice his public comment to the commission prior to the hearing and it would be recorded into the minutes:

Mr. Hartman is on the ERC environmental committee of Stevens Lake Homeowner’s association.  Mr. Hartman conducted a site visit with Nancy and he was show two things at the site.  One of them was a 20 X 30 ft clearing and he is questioning why there is a proposal to clear an area that has been already cleared.  Mr. Hartman also questioned the purpose of four little trees that are flagged and doesn’t understand why they are being flagged.  Mr. Hartman is a Marine Biologist, Fresh Water Biologist, and the steward for Steven’s Lake.  His concern is protecting the lake.  Mr. Hartman stated that the existing clearing and the path going to the lake was an Enforcement Order issued to the prior owner and as a restoration plan was not to be maintained and as a mitigation was to be allowed to grow in naturally and kept in the natural state. The hearing will be continued to November 13, 2019. 

New Hearings & Meetings (First Come First Served):

Notice of Intent filed by Steven Schwartz of 19 Buckingham Lane for the proposed construction and related site work for a new septic system within the buffer zone of Lake Garfield.

Brent White of White Engineering briefed the commission on the project.   There were no comments from the public.  The project was approved with standard and special conditions.  MSV KW/RC

 

Request for Determination filed by Nancy Anderson of 8 Tin Can Point for the proposed removal of trees within the buffer zone of Lake Buel.

Nancy Anderson briefed the commission on the project.  The RDA was approved with a negative 3 and with special order of conditions. MSV KW/JR

 

Request for Determination filed by Nancy Kassay of 26 Sylvan Rd for the proposed repair of existing retaining wall within the buffer zone of Lake Garfield.

Spencer Noel was in attendance on behalf of the applicant and briefed the commission on the project.  The project was approved with a N3 with special conditions.  MSV KW/JR

 

Request for Determination filed by Hillel M. Maximon of 360 Beartown Mountain Road for the proposed installation of a Pond Leveler to control the water level in a beaver pond.

Mr. Maximon briefed the commission of the proposed project.  KW asked Mr. Maximon to contact the commission with the name of the contractor.  The project was approved with N2.  JR/RC  MSV

 

Notice of Intent filed by Arlen Gelbard of 22 Point Rd for the proposed removal of a hemlock tree within the within the buffer zone of Lake Garfield. 

The property owner was absent from the meeting.  KW briefed the commission on the proposed project.  The project was approved with standard and special conditions.  KW/RC MSV

 

Continued Hearings & Meetings:

Notice of Intent filed by Jeremy Rawitz of 165 Steven’s Lake Way for the proposed clearing of 600 SF of vegetation within the buffer zone of Steven’s Lake.

Due to a lack of a quorum, the NOI was continued to the next hearing.

RC asked about Trout Pond.  KW stated that the OOC was drafted by New Marlborough and the project was mostly under the jurisdiction of New Marlborough with a small piece of the project in Monterey which was permitted under a RDA.
