New Hearings & Meetings:

PUBLIC MEETING: Request for Determination filed by Ehrlich of 26 NW Cove Rd, for the proposed removal of decaying trees.

David Ehrich, property owner, briefed the members of the proposed project.  JR conducted a site visit prior to the hearing.  Members are questioning the # of trees being removed and the number of plants for replanting.  11 trees will be removed.  Hydrangias or Rose of Sharon will be replanted approx. 8 ft tall. New plantings will be on the righthand side of the house.  The project was approved with a Negative 3 with special conditions: 11 trees removed, Planting will be done by 6.2021, plantings to be a minimum of 8ft tall.  NT/PC MSV

PUBLIC HEARING: Notice of Intent filed by Salomon of 126 Tyringham Rd, Map 220, Lot 47 for the proposed replacement of a flow control structure in a dam and the removal of vegetation on the berm in the outer riparian zone and resource area of a private pond.

Hearing opened at 6:44 pmShannon Boomsma (SB) of White Engineering briefed the members of the proposed project.  JR conducted a site visit prior to the hearing.  PC questioned the location of the berm and the replication area. SB replied to DEP Comments. The project was approved with Monterey special & standard conditions.   PC/JR MSV

PUBLIC HEARING: SMA Notice of Intent filed by Merlis of 0 Old Beartown Mt. Rd., Map 21, Lot 28, for the proposed associated site work for a single-family home.

Mike Kulig of Berkshire Engineering briefed the members on the proposed project. PC questioned the SMA and the WPA jurisdiction.  No comments from the public.  The project was approved with special condition: All forestry/tree cutting will be staged on site and not removed. PC/NT MSV

PUBLIC MEETING: Request for Determination filed by Feinman of 40 11 Limerock Lane, Map 102, Lot 68, for the removal of a decayed trees within the buffer zone of Lake Garfield.

JR briefed the members on the site visit and the RDA.  The project was approved N3 with special condition stumps to remain.  Plantings not permitted. PC/NT  MSV

Continued Hearings & Meetings:

PUBLIC HEARING:  Notice of Intent filed by Cutick of 525 Main Rd, Map 106, Lot 004 for the proposed associated site work and installation of a new bulk head within the resource area of Lake Garfield.

Continued to the next meeting.  PC/JR MSV

PUBLIC HEARING: Notice of Intent filed by Levin of 30 Elephant Rock Rd, Map 105, Lot 36 for the proposed associated site work for bank stabilization within the resource area of Lake Garfield.

Mr. Levin, the property owner, briefed the CC on the revised plan. Mark Stinson of DEP stated bank stabilization standards.  Adding vegetation to stabilize the bank after the stone is placed.   Members would like to see some native plantings mimicking another area and monitored for 2 growing seasons.  Approved with standard and special conditions PC/NT MSV

Enforcement Orders and Emergency Certs:

Continued to next May follow up in the spring and then close it out if compliance.  PC/NT MSV

SB of White Engineering briefed the members on the proposed restoration.  Restoration plan was approved with monitoring for two seasons. PC/NT MSV

Enforcement – 36 Camp Half Moon, Map 111, Lot 17- Wetland Violation –

Continue to next spring confirming mowing is not occurring and close out the enforcement. PC/NT MSV

Enforcement – 141 Stevens Lake Way – Map 003, Lot 85 –Potential Wetland Violation

Agent will mail enforcement order

Enforcement – 155 Stevens Lake Way – Map 017, Lot 23 – Potential Wetland Violation

Agent will mail enforcement order

Enforcement – 53 Swann Rd, – Map 000, Lot  00 - Potential Wetland Violation

Complaint from property owner across pond.  Agent will mail letter.

Amendments:

DEP File# 230-292, Simkowitz – Amendment to Order of Conditions – Continued

Amendment has not been submitted.

DEP File #230-290– Town of Monterey Library – Amendment to Order of Conditions

Mark Makuc of the Library briefed the members on the amendment.   Would like to substitute a split rail fence for the monuments.  The split rail fence would not prevent wildlife crossing.  Approved PC/NT MSV

Bidwell House Museum – Discussion – proposed trail project

Property Owners briefed the members on the proposed project.   All Stream Crossings will require a NOI.  Property Owners will schedule a site visit with members.

Beaver Dams on Konkapot River

Structures are not a risk.  Emergency not warranted.
