Conservation Commission Meeting Minutes 4/10/19

The meeting convened at 6:00 pm

HEARINGS WERE HELD ON A FIRST COME, FIRST SERVE

 

18 BIDWELL – ENFORCEMENT ORDER

A SITE EVALUATION WAS DONE TODAY BY MR. SCHWESBERG AND MR. COLONA.  APPOXIMATLY 75 SQ/FT OF DISTURBANCE PLUS OR MINUS WAS DETERMINED.  THE STREAM IS AN ISSUE CAUSING THE WASHING OUT THE BOATHOUSE.  THE NETTING HAS SLOWED DOWN SOME OF THE EROSION, HOWEVER,  IT IS ONLY A SHORT TERM FIX.  MATT AND JOE WILL DISCUSS OPTIONS OF PROTECTING THE SIDE OF THE BOATHOUSE AND THE FRONT STEPS.  THERE WAS SOME PREVIOUS WORK DONE WITH A BUNKER HEAD BUT IS DECAYING AND WILL EVENTUALLY GIVE OUT.  STREAM RESTORATION MAY NEED TO BE CONSIDERED AFTER GETTING THE ABUTTERS APPROVAL.  ML WILL SET UP A SITE MEETING ON MAY 8 AT 4 PM.  A PLAN WILL BE SUBMITTED ON APRIL 23 FOR THE MAY 8 MEETING.

27 DOWD – RDA – NEW CONSTRUCTION OF DECK

PROPERTY OWNERS O’BRIAN WERE IN ATTENDANCE AND HAVE OWNED THE PROPERTY FOR ABOUT 50 YEARS. THEY ARE REQUESTING TO REPLACE A PRIOR DECK IN THE SAME FOOTPRINT.  THE WORK WILL BE DONE BY HAND AND WILL NOT GO BEYOND THE FOOTPRINT OF THE PRIOR DECK.  KW BRIEFED THE COMMISSION ON THE SITE VISIT.  NO COMMENTS FROM THE PUBLIC. PROJECT WAS APPROVED WITH SPECIAL ORDER OF CONDITIONS.  MS/ML MSV

100 GOULD RD – NOI – CONSTRUCTION OF NEW COMMUNITY HOUSE

THIS IS A CONTINUED HEARING FROM THE PREVIOUS FIRST HEARING.  LISANNE FINSTON OF GOULD FARM AND ROB HOOGS OF FORSIGHT LAND SERVICES WERE IN ATTENDANCE REPRESENTING THE PROPERTY OWNERS.  DISCUSSION FOLLOWED REGARDING THE OUTSTANDING CERTIFICATES OF COMPLIANCE (COC) AND THE PRIOR OPEN ORDERS OF CONDITIONS.  TWO OF THE THREE CERTIFICATES OF COMPLIANCE WERE APPROVED.  A THIRD REQUEST FOR A COC WILL BE CONTINUED TO THE NEXT MEETING AFTER A SITE VISIT IS SCHEDULED.   DISCUSSION MOVED ON TO THE CURRENT PROJECT.  MR. HOOGS BRIEFED THE CC AND THE PUBLIC ON THE PROJECT.  COMMENTS FROM DEP WERE ADDRESSED.  STOCK PILING WILL BE DONE AT THE GRAVEL PIT AREA.  EROSION CONTROL WILL BE PLACED AROUND THE STOCK PILING.  THERE WERE NO COMMENTS FROM THE PUBLIC THE PROJECT WAS APPROVED WITH STANDARD AND SPECIAL ORDERS OF CONDITION. 10 NORTHWEST COVE – MINOR AMENDMENT TO DEP # 230-0287

ENGINEER MATT PUNTIN WAS PRESENT ON BEHALF OF THE OWNERS.  MR. PUNTIN BRIEFED THE CC ON THE STAIR PROJECT.  THERE WILL BE NO HEAVY EQUIPMENT INVOLVED IN THE CONSTRUCTION PHASE.  STAIRS WILL BE ON GRADE.  ML ASKED ABOUT ANIMAL PASSAGE. THERE WILL BE ADEQUATE ROOM FOR ANY ANIMAL PASSAGE.  MS. MAKUC ASKED ABOUT HAND RAILINGS.   RAILINGS WILL BE CONSTRUCTED TO CODE.  THE AMENDMENT WAS APPOVED AS A MINOR CHANGE TO ORDER OF CONDITION #13.  MS/ML MSV

CHARCOAL LANE – NOI – PROPOSED CONSTRUCTION OF NEW HOME

PROPERTY OWNERS ANDREW AND CICILAIA SABOROSKI, MATT KULIG (MK) AND AARON BIASON  (AB) OF BERKSHIRE ENGINEERING WERE IN ATTENDANCE AND BRIEFED THE COMMISSION OF THE PROPOSED PROJECT.  ML ASKED ABOUT DRIP EDGE AND STORM WATER RUN OFF.  MK EXPLAINED THE DESIGN AND THE NEW PLANTINGS PROPOSED.  LOCATION OF STOCKPILING LOCATION WAS ASKED BY ML.  ALL STOCKPILING WILL BE DONE OUTSIDE THE LIMITS OF THE PROJECT.   SABOROSKI PROVDIED A MODEL OF THE PROPOSED PROJECT TO THE PUBLIC.

RICHARD MONTGOMERY OF 6 DOWD RD WAS IN THE ATTENDANCE AND QUESTIONED WHY THE PROJECT WAS EVEN BEING CONSIDERED WITHIN 100 FT OF THE LAKE AND WHY THE GARAGE SITE WAS NOT BEING CONSIDERED FOR THE NEW CONSTRUCTION.  KW STATED THAT THOSE QUESTIONS SHOULD BE ADDRESSED AT THE ZBA HEARINGS.

JAMES SALERNO 8 DOWD RD. INFORMED THE PUBLIC AND THE COMMISSION THAT THE LAKESIDE STONE WAS PUT IN BY THE PREVIOUS OWNER.  MR. SALERNO HAD SEVERAL CONCERNS REGARDING THE CONSTRUCTION OF THE HOME WITHIN THE BUFFER ZONE AND FEELS THAT THE OWNERS CAN BUILD SUCCESSFULLY INTO THE HILL. 

APPROVAL HAS NOT BEEN RECEIVED AS OF DATE OF THE HEARING FROM NHESP FOR THE PROJECT.  THE HEARING WAS APPROVED TO CONTINUE TO THE NEXT MEETING.  ML/MS MSV.

73 CHESTNUT HILL – SMA #11-07

REPRESENTATIVES OF VERTEX TOWERS/HUME LAKE BRIEFED THE COMMISSION ON THE MINOR AMENDMENT TO THE SMA.  REQUEST IS TO MOVE THE TOWER 120’ SW OF THE ORIGINAL PLAN AS APPROVED BY THE ZBA REDUCING THE ACCESS ROAD. THE MINOR AMENDMENT UNDER OOC #13 WAS APPROVED. MS/ML MSV

24 LAUREL BANKS ROAD – NOI – PROPOSED SITE WORK FOR LANDSCAPE RESTORATION

MIKE KULIG AND AARON, LASSIER.  LASSIER BRIEFED THE COMMISSION OF THE PROPOSED RESTORATION.  PETER CLOSE OF 10 LAUREL BANKS LANE WAS IN ATTENDANCE AND WAS CONCERNED ABOUT SOME OF THE LANDSCAPING AND RESTORATION ENCROACHING ON TO HIS PROPERTY, THE EXISTING STONE WALL BETWEEN THE TWO PROPERTIES AND THE TREE STUMPS BEING REMOVED.  AN AGREEMENT WAS MADE BETWEEN THE CURRENT PROPERTY OWNERS AND THE ABUTTER ACROSS THE STREET REGARDING NEW PLANTINGS BEING SITED TO PREVENT ANY BLOCKAGE OF THE VISTA VIEW.  ALL STOCK PILING WILL BE DONE IN PICK UP TRUCKS.  THE PROJECT IS WAITING FOR NHESP APPROVAL.  THE PROJECT WAS APPROVED TO CONTINUE TO NEXT MEETING. 20 NORTHWEST COVE RD. – RDA – REPLACEMENT OF FAILD SEPTIC SYSTEM

THE PROJECT MANAGER BRIEFED THE COMMISSION ON THE REPLACEMENT PROJECT.  DISCUSSION REGARDING THE LOCATION OF THE PROPOSED SITE WORK AND IT’S CLOSE PROXMITY TO THE LAKE WOULD BE BETTER SUITED FOR A NOI FILING.   THE PROJECT WAS APPROVED FOR PHASE 1 ONLY WITH SPECIAL CONDTIONS.  MS/ML.  APPROVED 2-1

24 LAKESIDE TERRACE – DEP FILE # 230-0281

SHANNON BOOMSMA OF WHITE ENGINEERING INFORMED THE COMMISSION THAT THE PROPERTY OWNERS WOULD LIKE TO REPLACE A GARAGE THAT WAS DAMAGED BY FALLEN TREES AND TO REPLACE GUARDRAILS ON A DRIVEWAY BRIDGE AND WHETHER THE PROPOSED PROJECT SHOULD BE SUBMITTED AS AN AMENDMENT TO THE OOC OR AN RDA.  A SITE VISIT WILL BE SCHEDULED AT A LATER DATE.

ENFORCEMENT ORDERS:

4 POINT RD – QUAQLIATA

BERKSHIRE GEO TECH SUBMITTED A RESTORATION PLAN FOR REMOVING THE SAND.  KW INFORMED THE COMMISSION THAT THE REMOVAL OF THE SAND WAS STILL WAITING ON NHESP APPROVAL AND DUE TO THE LAKE BEING FILLED THE REMOVAL WILL HAVE TO BE MOVED OUT TO THE FALL.  AN AMENDMENT TO THE EO WILL BE SUBMITTED.

6 POINT RD – GREENWALD

KW INFORMED THAT THE OWNER HAS REQUESTED FOR THE COMMISSION TO RECONSIDER THE CONDITION FOR THE REMOVAL OF THE SAND BASED ON A HARDSHIP.  MS MOTIONED THAT THE EO IS TO REMAIN AS ISSUED, ML SECONDED.  THE CONDITIONS OF THE EO ARE TO REMAIN AS ISSUED AND APPROVED.

 

MISC:

APPROVAL OF MARCH 2019 MINUTES WERE CONTINUED FOR LACK OF A QUORUM OF SIGNATURES.
