Meeting Place: 435 Main Rd., Monterey Town Office.  Conference Room

The Conservation Commission for the Town of Monterey will hold a public hearing/meeting pursuant to M.G.L., c 131, section 40, the Wetlands Protection Act to act on the following:

Meeting Opened: 6:00 PM 

Members Present:  Chair: Chris Blair (CB), David Dempsey (DD), Tim Lovett (TL), Noel Wicke (NW), Agent K. Wetherell

NEW HEARINGS AND MEETINGS:

Public Hearing: WPA NOI DEP# 230-0329 Map 102, Lot 53, 7 Buckingham Lane filed by Berkshire Geo-Technologies for the associated site work razing of an existing single family home and new construction of a single family home. 

CB opened the hearing at 6:05 pm. 

C. Tryon of Berkshire Geo Tech briefed the members of the proposed project.  An existing 3 bedroom home will be razed and rebuilt as a single family home.  The proposed new construction will have screened in porch. The current septic system will remain.  The entire property is in the 100 ft. buffer.  Erosion control will be surround the property.  NHESP has determined no impact.  Two trees will be removed and replaced with shrubs.

Peter an abutter on the left of the property commented that the property is wet and that the proposed size of the roof is larger. He is concerned that the storm water runoff will increase and asks if measures may be conditioned such at gutters and drains to minimize the impact of storm water.  CB suggested a gutter and perk system might be applied. TL suggested a drip edge.  Janet Jensen suggested a rain garden.  Maureen Regen commented if tree cutting could be delayed in consideration for some tree swallows to finish nesting. Hearing closed at 6:34  CB/DD MSV.  Project was approved with special conditions. TL/CB MSV

Public Meeting:  WPA RDA Map 101, Lot 051, Tyringham Rd. filed by Town of Monterey Parks Commission for the proposed improvements and associated site work at the Lake Garfield Town Beach: Placement of Pollinator Planter Box, Placement of Boulder, and installation of electric wiring.

Mr. Clarin, representive for Parks Commission, briefed the members of the proposed project.  Mr. Clarin informed the members and the public that a revision to the proposed site locations needs to be added to the submittal allowing public safety to access the area..  NW asked about the need for electric. Mr. Clarin replied that all of the functions held at the park require electric and in the past they have been contracting contractors to supply the electric.  The project was approved with a Negative 3 including special conditions CB/DD MSV. 

Public Meeting:  WPA RDA Map 102, Lot 30-31, 14 Point Rd. filed by Kelly, Granger & Parsons for the installation and associated site work for a subsurface disposal system within the buffer zone of Lake Garfield. 

Mike Parsons of Kelly, Granger& Parsons briefed the members of the proposed project of replacing an existing failed system.  Existing tank will be pumped and removed.  New system will treat nitrogen and pumped across road  The project was approved with a Negative 3 TL/DD  MSV

Comments from the public:

Roslyn Dolber of 142 Main Rd. expressed her interest in becoming a member of the Conservation Commission.  Members agreed that Ms. Dolber would be a good candidate for the commission and briefed her of the continuing education available and attendance requirements.  CB advised Ms.Dolber to contact the Selectboard of her interest to be appointed.

Property owner, John Makuc, briefed the members on his plans for proposed updates to his property including the construction of a garage.  There was a discussion among the members and Mr. Makuc on the process of permitting.

24 Point – Ratify – Emergency Permit

Members were briefed on the trees posing a safety hazard.  It was agreed that the EP will be issued and ratified at the next meeting.

24 Lakeside – OOC File # 230-0326 – Request to Amend

Shannon Boomsma of White Engineering briefed the members on the reason for the minor amendment request.  Lightening has damaged one of the trees posing a safety hazard.  She is proposing to replace the tree with two other trees.

153 Hupi Rd - OML Complaint – Review, discussion, response

Chair Blair briefed the members on the complaint and drafted a response to the complaint.  Members reviewed the complaint and approved the response.

271 Main – EO – Update

The property owner has complied with the EO and the EO was approved to be closed.

80 Dowd – EO – Update

Property Owner attended and will submit a NOI for the unpermitted work by the next scheduled meeting.
