Meeting Place: 435 Main Rd., Monterey Town Office.  Conference Room

The Conservation Commission for the Town of Monterey will hold a public hearing/meeting pursuant to M.G.L., c 131, sections 39A & 40, the Scenic Mountain Act and the Wetland Protection Act to act on the following:

Meeting Opened: 6:00 PM 

Members Present:  Chair: Chris Blair (CB), David Dempsey (DD), Tim Lovett (TL), Noel Wicke (NW), Roslyn Dolber  (RD,) Kim Wetherell, Agent (KW)

NEW HEARINGS AND MEETINGS:

Public Hearing: NOI, Map 102, Lot 073, 20 Lime Rock, Property Owner: Edelstein filed by Berkshire GeoTech for the proposed improvements to an existing deck, sea wall, and walkway within the buffer zone of Lake Garfield.

Applicant requested the hearing to be continued.  Hearing Continued to next meeting.

Public Meeting: RDA, Map 103 Lot 015, 6 Lake Side, Property Owner: Wolinsky/ Emmel filed by Wolinsky/Emmel for the proposed improvements to a single-family cottage within the buffer zone of Lake Garfield.

Ms. Wolinsky briefed the members on the proposed project.  The request was approved with a N3 including the condition that all material be covered and erosion control in place.  CB/TL MSV

Public Meeting: RDA, Map 102, Lot 038, 40 Sylvan Rd, Property Owner: Lads Beach Assoc. filed by Lads Beach Assoc. for restorative sand on the bank of Lake Garfield.

Gerard Clarirn of Lads Beach Association briefed the members on the proposed project.  20 tons of sand will be is proposed to be placed on the beach.  No sand will go in the water and there will be no excavation.  CB commented that the replacement will change the charistic of the existing conditions.  The request was approved with a N2 TL/RD MSV

Public Meeting: RDA, Map 102 Lot 070, 17 Lime Rock, Property Owner: Putrino filed by Kelly, Granger, Parsons Assoc. for the proposed associated site work and installation of a replacement subsurface disposal system within the buffer zone of Lake Garfield. 

Mike Parsons of Kelly, Granger, Parsons Assoc.  briefed the members on the proposed project.  NW asked about the existing shrubs and trees and if they will be removed.  The project will not involve removing any shrubs or trees.  The request was approved with the condition that Commissioner TL be notified prior to the start of work.  TL/NW MSV

Public Meeting: RDA, Map 103, Lot 030, 153 Hupi Rd, Property Owner: Spector filed by White Engineering to construct a dock within the buffer zone of Lake Garfield.

Shannon Boomsma of White Engineering briefed the members on the proposed project and the revision.  Atty Susan Smith requested to see a copy of the plan.  The copy was provided to Ms. Smith.   The request was approved with a N2 CB/NW MSV

Certificates of Compliance:

File # 230-0296- 100 Gould Rd- Gould Farm

Jackson Alberti briefed the members on the completion of  File #230-0296.  A site visit was conducted on 7.11 by the agent and member NW.  The request was approved.  CB/TL MSV

File #230-0000 – 98 Stevens Lake – Simkowitz

The applicant asked to withdraw this request at this time and will re-submit at a later date.  The request was withdrawn

MISC:

Blue Hill Rd – Blue Hill Farm – Project Review – Agriculture exemptions

CB disclosed that he is a relative of the property owners. Condition 23b3.

The members were briefed on the proposed project and it was advised that the property owners submit an RDA to the commission for a determination for their proposed project.

153 Hupi Rd - OML Complaint – Update – Discussion

Susan Smith requested copies of the responses on the AG’s questions and emails to CB.  KW will copy her on the emails.

Bidwell Park Emergency Permit – Update – Discussion

CB updated the members on the compliance with the EP.

Minutes - Approve previous meeting minutes

Minutes for the June meeting was approved.

New Members:

Colta Ives introduced herself to the commission.  CB discussed the required attendance and continuing education.  Ms. Ives advised the commission that she may not be a viable canidate because she is not available for site visits and meetings year-round.

8 Dowd – EO – Update – Discussion

KW advised that the property owner is working on retaining an engineer.

36 Elephant Rock WPA Form 2- Ratify August 2021 Approval

Members agreed to ratify and send the determination to the property owners.

DEP Memo 6.15.2022 - WPA Regulatory Filing Requirements – Discussion

CB briefed members on the requirements for filing submittals

32 Sylvan Rd. – Dock State Approval – Review

Members reviewed

Review Correspondence – N/A

Agent Report – Time Sheet was approved.  Discussion regarding Agent compensation compared to other municipalities.  Agent will research.
