PUBLIC HEARING/MEETING

New Hearings & Meetings: (Applications are heard in the order they are received at the town hall)

PUBLIC HEARING:  Notice of Intent filed by Merlis of Old Beartown Mountain Rd, Map 217, Lot 21 for the proposed associated site work for a new driveway within BVW and buffer zone of an intermittent stream.

Mike Kulig, representing the applicants, briefed the members and the public on the proposed project.  Agent , MD & PC conducted site visits prior to the hearing.  PC questioned the status of ownership of the road.  Ben confirmed that the road is owned by the state.  Proposed limits of work were not flagged prior to the site visits and there is confusion on the proposed location of driveway.  SMA needs to be filed for portions of the application outside of the WPA jurisdiction.  Members decided that another site visit needs to be scheduled before conditioning the NOI.  Continued to the next meeting.  PC/JR MSV.

PUBLIC MEETING: Request for Determination filed by Cutick of 525 Main Rd, Map 106, Lot 4 for the proposed associated site work for the repair of a bulk head dock within the resource area of Lake Garfield.

Mr. Cutick briefed the commission on the proposed project.  JR advised the applicant to withdraw the application.  The applicant withdrew the RDA.

PUBLIC MEETING: Request for Determination filed by Holzer of 23 Point Rd, Map 102, Lot 22, for the proposed associated site work for the restoration of an existing single family home within the buffer zone of Lake Garfield. 

Mike Parsons briefed the commission on the proposed project.  Discussion ensued regarding the installation of piers that are not depicted on the plan.  Parsons will send a revised plan depicting the placement of piers for the front entrance.  The Determination was approved with a N3 with conditions PC/MD  MSV

 

Enforcement Orders and Emergency Certs:

Enforcement - 399 Main Rd – Potential Wetland Violation – continued

PC conducted a site visit.  Members discussed how to go forward with the EO.  Decision was made that it would be best to let the area revegetate, no further brush hogging, and regular monitoring as needed.  Agent will send a map highlighting the area to revegetate in perpetuity to the property owner along with the requirements of the EO.  PC/MD MSV

Enforcement – 11 Limerock – request for extension on restoration planting.

Extended to May 31, 2021  PC/MD  MSV

Enforcement – Camp Half Moon – Potential Wetland Violation

Agent briefed the members on the potential violation.  Site visit will be scheduled.

Enforcement – 70 & 80 Williams Lane – Wetland Violation

Agent briefed the commission. EO will be issued to the property owner

Emergency Certificate – 151 Gould Rd – Ratify

Misc.:

Monterey Conservation Commission to accept the following policy during the current State of Emergency, resulting from the presence of COVID- 19:

To authorize the Agent to sign on behalf of the commissioners any and all documents for any entity that accepts electronic signatures for a period of 45 days after termination of the Governor’s March 10, 2020 Declaration of a State of Emergency.  The Commissioners recognize and accept the provisions of M.G.L. c. 110G regarding electronic signatures and the Commissioners will henceforth execute documents either with electronic signatures or with wet ink signatures and that both will carry the same legal weight and effect.
