  1. Introduction of Commissioners: Present Rawaitz, Tomasovich, Zisser, Lichter
  2. Public Input: None
  3. Request for Determination of Applicability for 23 Laurel Banks Road (Map 113, Lot 33) for landscaping and removal of trees in the buffer zone of Laurel Lake.  Applicant is Stephen Solosky: Zisser motions for positive determination, Lichter seconds, vote is unanimous.
  4. Ratification of an Emergency Permit issued to Monterey Highway Department to replace a failed culvert on Beartown Mountain Road:  Zisser motions to ratify, Lichter seconds, vote is unanimous.
  5. Ratification of an Emergency Permit for 32 Sandisfield Road for drilling new well: Zisser motions to ratify, Lichter seconds, vote is unanimous.
  6. Approval of minor change of plan for 16 Point Road under existing Order of Conditions: Zisser motions to approve, Lichter seconds, vote is unanimous.
  7. Request for Determination of Applicability for 72 Brett Road (Map 218, Lot 21) for the installation of dock.  Applicant is Sam Wadsworth.  Zisser motions for negative determination, Tomasovich seconds, vote is unanimous.
  8. Request for Determination for 30 Sylvan Road (Map 102, Lot 43) for removal of trees in the buffer zone.  Applicant is Sabrina Simon: Zisser motions to continue to 10-19-21, Lichter seconds, vote is unanimous.
  9. Request for Certificate of Compliance for 126 Tyringham Road (Map 220, Lot 47) for work on pond overflow.  Applicant is Morton & Teri Salomon. (MA DEP File #230-0314): Lichter motions to issue Certificate of Compliance, Tomasovich seconds, vote is unanimous.
  10. Request for Certificate of Compliance for Seven Arts Road (Map 111, Lots 23.3, 24, & 25, MA DEP File #230-0202.  Applicant is Thomas & Sanford Haver: Lichter motions to issue Certificate of Compliance, Rawitz seconds, vote is unanimous.
  11. Request for Plan Change  for 10 Northwest Cove, MA DEP File #230-0287: Zisser motions to approve, Lichter seconds, vote is unanimous.
  12. Notice of Intent for 31 Sackman Way (Map 114, Lot 29) for construction of addition to residence in buffer zone of Lake Buel & Bordering vegetated wetlands.  Applicant is Joseph & Elizabeth Catino: Tomasovich motions to issue Order of Conditions with standard & special conditions, Lichter seconds, vote is unanimous.
  13. Paul Wilson-Request for building suitability: Members did site visit, and gave information on location of perennial stream located on property.  Members unable to provide building suitability on the lot.
  14. Request for Determination of Applicability for 66 Elephant Rock Road (Map 105, Lot 14) Applicant is Sean Mueller: Tomasovich motions to remove from Agenda until Request for Determination is received, Lichter seconds, vote is unanimous.

Additional Items:

  1. Discussion: Attendance & Contribution from Commissioner Margo Drohan: Zisser motions to recommend that the Board of Selectmen reach out to Ms. Drohan to see if she wants to participate, Lichter seconds, vote is unanimous.
  2. Review of complaint regarding Conservation Commission letter to Board of Selectmen and executive session:

Review of accountant meeting with Commission member Michael Zisser regarding Conservation Commission accounts & penalties fund:  Zisser reports he had a constructive conversation.  Fines go to Conservation Trust Fund.  Discussion of obtaining permission to consult with Town Counsel on how to set up Conservation Accounts.  Zisser motions for Rawitz to go to Select Board for permission to consult with Town Counsel about how to set up Conservation Accounts, Tomasovich seconds, vote is unanimous.
  4. Missing emails: Zisser motions to examining detention & storage of emails from January 2021 through September 2021, Lichter seconds, vote is unanimous.
  5. Update re: work conducted in a Right of Way on Laurel Banks Lane by Philip Schoch;
  6. Budget for Fiscal Year 2022:
  7. Review and Approval of August 10, 2021 Conservation Commission Meeting Minutes:  Continued to next meeting.

  10. Chapter 91 Simplified Dock License for 153 Hupi Road for Ira Brind & Stacey Spector: No RDA for dock, and abutters object to location of dock. Continued to next meeting
  11. Adjournment:  Tomasovich motions to adjourn, Zisser seconds, vote is unanimous.
