Conservation Commission Minutes

The meeting convened at 6:00 pm

18 BIDWELL – ENFORCEMENT ORDER

Atty Colona and Mark Schwesberg of Wetland Strategies and Solutions were in attendance representing the property owner.  Atty. Colona stated that they have visited the property and reviewed the Enforcement Order and the conditions including the timeline.  The weather has made it difficult to define the scope of the unpermitted alteration, disturbance and draft a restoration plan.  There is an erosion issue caused by a stream that continues to wash out and undermining the boathouse.  Atty. Colona explained that their goal is to resolve the enforcement order and come up with a long-term plan to protect the boathouse.  Mr. Schwesberg will do an assessment once the snow is cleared.  KW noted that the lake will be rising soon.  JR questioned what observations have been noted as of date.  Mr. Schwesberg noted that a wetland has been flagged and some disturbance at the end of the stream and under the boathouse.  Some additional piles have been driven in the resource area and some of the piles are older than others.  Due to the snow cover and weather, the mean high-water line is difficult to determine.  A valid dock license was questioned.  MS provided photos of the site for reference.  MS informed the Con Comm that the enforcement order should be separate from permitting.   The Enforcement Order is to make the site stable including restoration and any additional work would have to be permitted.  ML questioned the time line of the EO.  Mark Schwesberg asked for an extension on some of the dates but assured the Con Comm that the compliance date of June 10th would be met.  MS suggested not changing the enforcement order.  The date for the restoration can be extended giving time for an NOI to be submitted for some of the work, an OOC would then be issued to allow some of the work before the EO compliance date of June 10th.   The OOC can trump the EO and so that some work under the OOC would be permittable and then the EO can be modified.  Preferably the OOC will come first before June 10th, the restoration of the EO would become part of the OOC for any work that is permittable. If an NOI is not submitted before June 10th, then a restoration would have to take place.  The Con Comm would be looking for a plan by the next meeting.  Mr. Schwesberg will do an assessment.  KW noted that the piles went in after the EO was issued.  Photos taken before the EO was issued do not show the piles.  Atty, Colona will check with the property owners.  MS reminded that the property is in Priority Habitat (MESA) and approval will be needed.  Atty. Colona and Mr. Schwesberg will submit a plan for the next meeting.

100 GOULD RD – NOI – CONSTRUCTION OF NEW COMMUNITY HOUSE

ML stated for the record that he is an employee of Gould Farm and is not in receipt of any financial numeration for the project.  Rob Hoogs and Aaron of Foresight Land Services, Lisanne Finston, executive director of Gould Farms, and Robert Harrison of Berkshire Design Architect were in attendance and briefed the Commission and the public of the proposed project and site work.  A site visit was conducted earlier in the day.  Plans were provided for reference.   Some changes to the plan were reviewed including the additional driveway work and a vehicle charger utility area.  They are currently addressing some of the DEP comments and requested to continue the hearing until the responses are complete.  Outstanding OOCs that have not been issued COCs was discussed.  Site visits for the outstanding OOC’s will be conducted so a request can be submitted to issue a COC.  ML noted some comments that were made at the site visit.  There were no comments from the public.   Motion was made and approved to continue to the next meeting. 126 TYRINGHAM RD – SALOMON – NOI – PROPOSED CONSTRUCTION AND RELATED SITE WORK FOR A GARAGE AND DRIVEWAY.

Shannon Boomsma of White engineering was in attendance representing the owners.  Ms. Boomsma briefly described the proposed project and site work.  A site visit was conducted by the members of commission prior to the hearing.    There were no comments from the public or DEP.  A motion was made to close the hearing and the project was approved with standard and special order of conditions.  JS/ML MSV.

 

52 SYLVAN RD – SUTTIN – RDA- PROPOSED CONSTRUCTION AND RELATED SITE WORK FOR A MUDROON, PATIO, WINDOW WELL.

Jackson Alberti of Foresight Engineers was in attendance representing the owners.  Mr. Alberti briefed the Commission and the public of the proposed project and site work.  A site visit was conducted by the members of the commission prior to the hearings.  There were no comments from the public or DEP.  A motion was made to approve the project with a negative determination with special conditions.  JS/ML MSV.

 

22 POINT RD – GELBARD – RDA – PROPOSED RELATED SITE WORK FOR DRAINAGE IMPROVEMENTS.

Shannon Boomsma of White engineering was in attendance representing the owners.  Ms. Boomsma briefly described the proposed project and site work.  A site visit was conducted by the members of commission prior to the hearing.    MS stated that there are two docks in violation of Chapter 91.  There were no comments from the public or DEP.  A motion was made to approve the project with a negative determination with standard and special order of conditions.  JS/ML MSV.

 

24 LAKESIDE TERRACE – DEP FILE # 230-0281 – GARFIELD LAKESIDE NOMINEE REALTY TRUST – DEP #230-0281 – AMENDMENT – PROPOSED INSTALLATION OF STORM WATER CULVERT AND REMOVAL OF SHARP ROCKS AND FALLEN WOOD FROM SHORELINE.

Shannon Boomsma of White engineering was in attendance representing the owners.  Ms. Boomsma briefly described the additional proposed project and site work.  The amendment was approved as a minor change in plan. ML/JS MSV.

 

ENFORCEMENT ORDERS:

4 POINT RD – QUAQLIATA

KW informed the commission that Berkshire Engineering has been retained by the property owners to submit a plan for removing the sand and restoration of the retaining wall.  Mr. Tyron submitted a plan and the commission accepted the plan as submitted.  KW will inquire whether NHESP has given approval.

6 POINT RD – GREENWALD

KW informed the commission that Berkshire Engineering has been retained by the property owners to submit a plan for removing the sand and restoration of the retaining wall.  Mr. Tyron submitted a plan and the commission accepted the plan as submitted.  KW will inquire whether NHESP has given approval.
