Continued Meetings:

Public Hearing – Common Driveway of Ellen Kurtz of 93 Fairview Road, Map #219, Lot #008 in accordance with the Monterey Zoning Bylaw Section 7.1 – Continued

Tom Sawyer stated that there were no comments from the ConCom and the Highway Dept.  TS made a request that if there is a drainage problem in the future that they contact the HWY. Atty Glover stated that any concerns can be addressed to the homeowner who has offered any assistance.  TS stated that because there is not a quoum, it will be approved by default.  Agent will draft a letter to the building inspect and copy Atty Glover of the approval by default.

Short Term Rentals – Discussion

Mr. Marton approached TS about Short Term rentals.  SM  briefed his concerns to the PB regarding short term rental including that the property owner is conducting a business, using a driveway easement on private property, and thinks that this type of activity should require a special permit.  SM cited the zoning bylaws.

SM is concerned that the town is losing revenue and provided a website listing rentals in Monterey.  LM has noticed a increase in rentals near her home as well since the Covid.  SM replied that this should be of great concerned with the covid and the transmission.  LM thinks that since the B & B are taxed by the state is they are being rented through the website and therefore can be taxed by the town.  TS asked if Mr. Marton knew the neighbor and if they live there.  SM does not believe that the neighbor lives there.  RT asked about the Right Away/Easement.  RT believes that the easement is not really his land.  SM believes that it is impacting his home.  TS thinks that the issue should be addressed and should bring it back to the table.

 LM wonders if there can really be any kind of regulation and enforcement.  TS stated that there is a Zoning bylaw (Bed & Breakfast) and wonders if there might be a safety issue and if the town should be made aware of the rentals for the security reasons.  RT stated that this practice has been going on for some time. TS questions if there should be a public hearing when there is more of a quorum.  The discussion will be continued to the next meeting.  BRBO website.  Agent will look up Mr. Marton’s address.

Noise Complaint – Shooting Range Discussion – Continued.

TS recommended that no further discussion at this time.  Members in attendance agreed.
