Solar Bylaw
Rob Hoogs presented 3 small changes made to draft previously presented to PB based on
recommendations by town counsel
2.2.3 – original draft said “normal” dimensions…deleted normal….in last sentence of first
paragraph.
 
Section 2.3 – current by law said “insert provided map properly”…draft eliminates this phrase.
Inserted map of the two parcels (Fox Hill and Landfill) this by law would apply to.
For limited revision ….for landfill parcel…..not a comprehensive change to by law
 
Not proposing to remove Fox Hill from the by law…it’s permitted by right….REWG not
recommending the site for solar but not recommending removing it as an option.
 
Not great for large scale ground mount but would be appropriate for roof mount if property
used for work force housing or a municipal building.
 
MA general law dealing with solar zoning, insistent that regulation should be limited…pushing
to make solar easier….40A section 3
 
Attorney General will have to approve bylaw if Town approves.
 
Will be published in Berkshire Eagle by 1/9 and mail notice to neighboring planning boards
and post in town hall, with goal of public hearing at scheduled PB meeting January 25th.
 
Motion to move forward with solar bylaw as presented. Mort made the motion, Chip
seconded. All approved.
 
23 7 Arts Road
Special permit application
Under one property as a condo assoc.
Have individual property lines within the larger lines
Condo exclusive line as the property line
Kyle is neighbor on property.
 
This is a non conforming property because inside the 40’ mean high water set back
 
Stairs could encroach on the setback but the plans do not specify distance of structure to
condo exclusive line,
Set back is 25 feet…
 
The proposed stairs do not impact the non conforming aspect of the property unless it
encroaches on the side set back of drawing.
 
Because the proposed stairs may increase the non conformity and it is not clear from
drawings if they do, the PB is requesting clarification.
 
Sign Permit for MT Hunger Road for Monterey Land Trust property which is now managed by
BNRC.
 
Sign will not be lighted. It is 3.88 square feet and 10 feet from the road. Hiking identification
sign similar to sign for Bob’s Way and Stedman Pond.
In Ag Res district…signs shall not exceed 4 square feet.
 
Tom moved to approve sign as presented, Roger seconded, all approved.
 
Mort will draft letter to the applicant giving PB approval.
 
Next meeting will be with SB on 1/11 at Town Hall to begin discussing where/how to start.
implementing some aspects of master plan with focus on housing and next steps.
 
Chip made motion to adjourn. Tom seconded.
