ZBA Hearing Minutes

Hearing began at: 3:00pm
Members Present: Jonathan Levin, Chair, Gary Shaw, Clerk, Scott Jenssen, Susan Cooper and Michael Banner, Alternate
Also present: Sarah Gapinski
Prior to beginning the hearing for 34 Bidwell Rd the Board addressed the following administrative items:
- Welcome Michael Banner who was appointed as an alternate to the Zoning Board of Appeals.
- Acknowledgement of Stanley Ross’s resignation. The Board state that he served the Board ably for a long time and his presence will be missed.
- Since Stan has resigned there is a vacancy in the seat of Clerk. Gary has volunteered. A motion was made to appoint Gary Shaw as the Clerk which was seconded and unanimously approved.
The hearing for 34 Bidwell Rd began with Jonathan Levin, Chair, explaining the hearing process and then Gary Shaw, Clerk, read the legal notice (which was posted for 2 consecutive weeks in the Berkshire Eagle and at the Town Hall) and letters from the Planning Board, Conservation Commission, Board of Health and one abutter.
Sarah Gapinski of SK Design Group presented the project details and the applicants request for a variance. The Board reviewed the variance requirements that must be met with Ms. Gapinski as well as their concerns for allowing anything within 40ft of the lake and how any approval of this proposal would be a derogation of the bylaw.
The applicant’s representative verbally requested permission to withdraw the application without prejudice which will be confirmed in writing. A motion was made to accept the withdrawal without prejudice which was seconded and unanimously approved.
