Executive Session Minutes of 5/4/22
Meeting Opened at: 12:05pm
Select Board Members Present: Steve Weisz, Chair, Justin Makuc
Also present: Tom Sawyer and Jeremia Pollard
The Board discussed entering executive session to meet with former counsel Jeremia Pollard to discuss legal strategy pursuant to MGL Chapter 30A Section 21 (3). A motion was made to enter executive session pursuant to MGL Chapter 30A Section 21 (3). The motion was seconded and approved 2 – 0. The Board will return to open session. The Board went into executive session at 12:05pm.
Jeremia reviewed the court’s decision with regard to the Hume appeal. Jeremia is confident that Hume will appeal the decision and Jeremia recommends the Town also file an appeal.
As Jeremia is no longer Town Counsel and current Town Counsel (KP Law) is in the process of resigning from Monterey. Jeremia stated that he is not willing to file an appeal for the Town unless he is hired to follow through with the appeal. There are numerous deadlines and expenses that are required once the process begins.
Tom Sawyer, Chair of the Planning Board is in favor of continuing to use Jeremia for the appeal as he is familiar with the case.
Jeremia estimates that the appeal will cost the Town approximately $3,500 – 4,000.
A motion was made to file the appeal and hire Jeremia Pollard as counsel to begin immediately. The motion was seconded and approved 2 – 0.
A motion was made and unanimously approved to adjourn the meeting and return to open session at: 12:37pm
